i believe i may be the victim of a property rental scam. I need advice on what to do...?

I rent a studio attached to the house of a family, whose head I pay rent to (presumably my landlord). I did sign a lease upon moving in. I have no way of knowing if the man I've been paying rent to is the real owner of the house, or if he is just renting the house himself. The family is now supposedly buying another house in a neighboring town, but he will continue to rent me the studio while he rents the rest of the house out through a management company. His family has already moved out. I'm worried that he was never the true owner of the house, and that he has moved out, leaving me in the house appearing to be a squatter. If I get an eviction order/notice from whomever may really own the property, how long do I have to vacate considering that I may not have had a legal agreement with the true owners of the house?

contact the the tax assessors office in which the property is located- and ask for the owners name of the property on record, and address if you have been paying by mail. this is public information and they should tell you over the phone although - you may need to go down there and look it up. if it is not the owner of the property that you have been paying then you need to confront the person you have been paying. they may be a property manager or someone appointed by the owner to rent it out and collect monies, if that is the case then you lease is still good. if not then you should try to track down the real owner and tell them of the situation- in some cases subletting is ok - in other cases it is not, it really depends on the lease agreement that that person had originally, and what the real owner(whoever it is) knows of this or thinks of this. if you signed this lease with no knowledge of wrong doing then you will be safe for a while- a few months at least. if the person who rented it to you did so without permission from the owner then they are the one to be in trouble- but if the owner really is not aware you are there - they can and probley will evict you - but the judge should see you were stuck in a bad situation and will probley give you several months to move (3 to 4 maybe). sadly you will have to waste your time and show up at court a few times. you can always bring a small claims suit for the stress and moving costs against the person who rented the place if your lease is found to be invalid...but who knows if anything will come of it.

Can a tenant use a rental home for a business?

Hi. I have a tenant who told me they were going to get commercial space for their business. They have actually decided not to and to run the business from the home.

Their business is such that people come to the property for a service. I do not want to be responsible for anything happening as a result of this business so do not want them running this business from the home.

This is in the rental agreement:
Tenant shall use the House only for residential purposes.

I am not aware if people have been to the house on business, but do know that they are running the business from the house (I have seen this and they have also told me). I also received a copy of their business forwarding address which is the home address. They have also told me that they had their business mail forwarded there.

I am also mislead because they told me they were going to get a separate space for business.

We are in Oregon if that makes any difference.

You need to nip this mess in the bud quickly. If you allow it to continue, you could be held liable for possible injuries sustained by one of their customers. As well, you may also be violating residential zoning laws by allowing this activity to continue.

Your insurance won't cover injuries if they become aware that the premises are being used for business purposes.

Write a professional letter to these tenants NOW, with a copy of the lease indicating that the premises are for residential purposes only, and send it via certified mail with return receipt requested. Give them a week to discontinue their business activities and then physically check to see that they have complied. If they do not comply, start an eviction process based upon violation of the lease contract.
